(Annual 2010) The Categorical and Modified Categorical Approaches Post-Nijhawan and Silva-Trevino Part 1

Session Id: IL10-AC98 Type: Downloadable

Description

The recent Supreme Court decision in Nijhawan fundamentally changed the categorical analysis for aggravated felonies, and possibly other removal grounds, and opened the door for evidentiary hearings in immigration court. Similarly, the BIA's Silva-Trevino decision creates challenges for attorneys litigating crimes involving moral turpitude. This panel will provide an up-to-date legal analysis and discuss what evidence can and should or cannot and should not be presented in court.
